1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Ononot ("Ononot", "we", "us", or "our"), governing your access to and use of the Ononot website, platform, content, APIs, and associated services (collectively, the "Service").

By creating an account, accessing, browsing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you must immediately cease all access and use of the Service.

2. Eligibility & Account Registration

You must be at least 13 years of age (or the age of digital consent in your jurisdiction) to use the Service. By registering an account, you represent and warrant that:

• You will maintain and promptly update your account information.
• You are solely responsible for safeguarding your password, login credentials, and all activities that occur under your account.

We reserve the right to suspend or terminate accounts that contain false, misleading, or inactive credentials without prior notice.

Ononot is provided strictly for informational, educational, and practice purposes. While we strive to maintain accurate, high-quality mathematical problems, solutions, diagrams, and explanations, we make no representations or warranties regarding:

• The absolute accuracy, completeness, correctness, or pedagogical efficacy of any practice question, mathematical diagram, automated explanation, or score.
• The outcome of any standardized test, academic examination, professional certification, or educational endeavor.

YOUR USE OF THE SERVICE AND RELIANCE ON ANY CONTENT OR ASSESSMENT IS ENTIRELY AT YOUR OWN RISK.

4. Intellectual Property Rights

All content, software, design, logos, graphics, mathematical problems, taxonomies, solutions, algorithms, text, code, and user interfaces available on or through the Service are the exclusive intellectual property of Ononot and its licensors, protected by copyright, trademark, trade secret, and other intellectual property laws.

Subject to compliance with these Terms, Ononot grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service strictly for your personal, non-commercial educational use. You agree not to:

• Copy, reproduce, modify, distribute, license, sell, republish, or create derivative works from the Service or its content without express written consent.
• Scrape, spider, crawl, harvest, extract, or bulk-download any questions, solutions, diagrams, or database entries through automated or manual means.
• Reverse engineer, decompile, disassemble, or attempt to derive source code or underlying data taxonomies from the Service.

5. Acceptable Use Policy & Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Attempting to interfere with, disrupt, overload, or compromise the integrity or security of our servers, networks, or databases.
• Bypassing or circumventing rate limits, guest attempt restrictions, paywalls, or authentication mechanisms.
• Using bots, scripts, automated submitters, or abusive submission tools to artificially manipulate leaderboard stats, challenge times, or mastery scores.
• Impersonating any person, entity, or administrator, or misrepresenting your affiliation with any entity.
• Using the Service for any unlawful, fraudulent, or malicious purpose.

6. Automated Features & Content Disclaimers

Portions of the platform, solution checks, automated scoring, and performance analytics are powered by automated algorithmic systems. While we continually refine our problem sets, explanations, diagrams, and validation logic, automated feedback may occasionally contain errors or omissions. Ononot is not liable for any misstatements, errors, or reliance on automated explanations or mathematical assessments.

7. Disclaimer of Warranties ("AS-IS")

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

ONONOT EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, FREE OF VIRUSES OR HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ONONOT, ITS FOUNDERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO:

• YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE;
• ANY ERRORS, MISTAKES, OR INACCURACIES IN ANY CONTENT, SOLUTIONS, OR STATS;
• ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN;
• ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE;
• ANY BUGS, VIRUSES, TROJAN HORSES, OR MALICIOUS CODE TRANSMITTED THROUGH THE SERVICE; OR
• ACADEMIC OR EXAMINATION RESULTS, ADMISSIONS OUTCOMES, OR EMPLOYMENT DECISIONS.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO ONONOT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY UNITED STATES DOLLARS ($50.00 USD).

9. Indemnification

You agree to defend, indemnify, and hold harmless Ononot, its officers, directors, employees, contractors, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to reasonable attorney's fees) arising from:

• Your use of and access to the Service;
• Your violation of any term or provision of these Terms;
• Your violation of any third-party right, including without limitation any intellectual property, privacy, or proprietary right; or
• Any claim that your conduct or submissions caused damage to a third party.

10. Account Termination & Suspension

We may suspend, disable, or terminate your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service immediately ceases. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law & Dispute Resolution

These Terms and any action related thereto shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the federal or state courts located in the State of California, and you irrevocably submit to the exclusive personal jurisdiction and venue of such courts.

12. Modifications to Terms & Service

We reserve the right, at our sole discretion, to modify, update, replace, or discontinue these Terms or any part of the Service at any time. If a revision is material, we will provide reasonable notice prior to any new terms taking effect (such as by posting an update notice on the platform). By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
